Privacy Policy – AwesomeSMS

1. Who owns the service

The owner and entity responsible for operating awesomesms.com is Monolynx Piotr Krych, ul. Brzoskwiniowa 57D, 15-584 Białystok, Poland. Contact: piotrkrych@monolynx.com.

2. Role allocation (GDPR)

• Monolynx Piotr Krych acts as the data controller for its customers (users who create an AwesomeSMS account).
• The customer (application user) is the controller of the contacts added to the application, while Monolynx acts as the processor, acting only on the customer's documented instructions and under the agreement and terms of service.

3. Categories of data

Customer data (application users): first name, last name, email address, phone number, billing details (e.g. tax ID, address), login history, account/license configurations.

Customer contacts' data: phone number, name and any additional information provided by the customer. The customer, as controller, is responsible for the scope and accuracy of this data.

4. Purpose and scope of processing

We process data to:

• Provide the AwesomeSMS service (create and maintain the account, billing, support, security).
• Handle SMS dispatch and automation on behalf of the customer.
• Enable integrations (e.g. Google Calendar) to the extent required for selected features.
• Deliver operational communications, including technical notices, terms updates and security information.

5. Legal bases (GDPR)

• Article 6(1)(b) GDPR – performance of the contract (providing the service to the customer).
• Article 6(1)(f) GDPR – legitimate interests of the controller (security, fraud prevention, handling complaints).
• For customer contacts, the customer as controller defines the legal basis and fulfils the information obligations towards those individuals.

6. Google integrations (including Calendar)

When a Google account is connected to AwesomeSMS, the application accesses only the scopes required for the selected feature (e.g. calendar.events or calendar.events.readonly). Google data is used solely to generate SMS reminders and similar functions.

The customer can disconnect the integration at any time in their Google settings. AwesomeSMS does not sell Google data or use it for its own or third-party marketing.

7. Data recipients and subprocessors

We entrust data to trusted providers (e.g. hosting, maintenance, payment systems, security) solely to deliver the service. These entities process data under data processing agreements and in line with the GDPR. Customer contacts' data is not used by Monolynx for any own purposes.

8. Storage and retention

• Customer data – for the duration of the contract and for statutory periods (e.g. accounting, pursuing claims).
• Customer contacts' data – until the customer deletes it or the processing basis on the customer side expires.

9. Data subject rights

• Customers have the right of access, rectification, erasure, restriction, data portability and objection under the GDPR.
• Individuals whose data has been entered by the customer should address their requests directly to that customer as controller. If a request reaches Monolynx, we will pass it on to the appropriate controller.

10. Security

We apply technical and organisational measures appropriate to the risk, including encrypted transmission, access control, event logging, testing and monitoring. Data is available only to authorised personnel and solely to the extent required to deliver the services.

11. Cookies and similar technologies

The service may use cookies and similar technologies for essential, statistical and functional purposes. Details on usage and consent management are provided in the cookie policy (if a separate document or consent banner is available).

12. Transfers outside the EEA

If data must be transferred outside the European Economic Area, it is done in accordance with the GDPR (e.g. adequacy decisions, standard contractual clauses). We inform users whenever such a transfer occurs within the services we use.
